EU AI Act Article 14 requires that every high-risk AI system be designed so that a human can understand, monitor, and override AI outputs before decisions take effect. Most teams implement a version of this that does not meet the standard: a human sees the AI output and clicks "approve." That is not oversight — it is automation bias with a signature.
At a glance: EU AI Act human oversight has two components: design requirements (the provider must build a system that makes oversight technically possible) and implementation requirements (the deployer must actually implement oversight, not just have a policy stating it exists). For employment, credit, healthcare, and other Annex III decisions, affected individuals must also receive notice that AI was used and have the right to request human review. Rubber-stamping AI recommendations is not oversight under the EU AI Act.
What Article 14 Actually Requires
EU AI Act Article 14 specifies that human oversight measures must enable persons overseeing the AI to:

Fully understand the AI system's capacities and limitations — not just know that an AI exists, but understand what it is doing, what data it is using, and where it is known to fail.

Monitor the AI system's operation — detect anomalous outputs, identify systematic errors, and track performance over time against known benchmarks.

Identify when to disregard or override the AI's outputs — the human must have the tools, time, and authority to reject AI outputs when their judgment requires it.

Intervene on or halt the system — when the AI is producing harmful or inappropriate outputs, a designated person must be able to stop it.
The provider's design obligation: The AI system must be technically designed so these four capabilities are possible. If the interface does not show the AI's reasoning, does not flag low-confidence outputs, does not allow decisions to be held pending human review, or does not have an accessible override mechanism, the design is non-compliant.
The deployer's implementation obligation: The deployer must actually use those capabilities. Designating a human reviewer who lacks access to the AI's reasoning, lacks the time to review, or lacks the authority to override is not compliant oversight — it is the form of oversight without the substance.
What Does Not Count as Human Oversight
These common implementations fail the EU AI Act standard:
The checkbox reviewer. A human who reviews an AI output and clicks "approve" without examining the underlying reasoning or data is not providing oversight — they are creating a liability record. EU AI Act oversight requires that the human actually evaluates the output, not just acknowledges it.
The overburdened reviewer. If the human reviewer is expected to review 300 AI-generated candidate scores per day with 2 minutes per review, meaningful oversight is not occurring. The volume of AI outputs must be calibrated to allow genuine human review, or the review process is not meaningful.
The underinformed reviewer. A human reviewer who cannot see the AI's confidence score, the features that drove a recommendation, or the AI's documented failure modes cannot exercise informed judgment. Oversight requires understanding.
The toothless reviewer. If the human reviewer's override is discouraged, overridden by managers, or creates workflow friction that makes it practically unavailable, the override mechanism is not genuinely accessible. The system design must make overriding the default path when the reviewer's judgment disagrees.
The policy statement. A written policy that says "humans review all AI decisions" does not implement oversight. The conformity assessment must demonstrate how oversight is technically built into the system.
Human Oversight for Deployers: The Implementation Checklist
If you are a deployer using a high-risk AI system (employment, credit scoring, clinical AI, education access), implement oversight as follows:
Designate a specific human reviewer
- Identify by name and role who is responsible for reviewing each AI-assisted decision
- The reviewer must have competence in the domain (an HR manager reviewing AI resume scores; a loan officer reviewing AI credit risk summaries; a clinician reviewing AI clinical recommendations)
- The reviewer must have protected time — reviewing AI outputs is a job function, not an add-on to an already full workload
Give the reviewer access to the AI's reasoning
Before the reviewer signs off on an AI-assisted decision, they must have access to:
- The AI's output (recommendation or score)
- The key inputs that drove the output
- The AI's confidence level or uncertainty flag
- The documented failure modes and known biases for the specific AI system
- The comparison population used by the AI (e.g., what pool of candidates are scores relative to?)
If your AI vendor does not provide this information, they are not providing adequate information for you to implement human oversight — and their product may not be EU AI Act compliant for high-risk deployment.
Build override into the workflow
- The override must be available in the primary workflow, not buried in settings
- Override decisions should be recorded with a reason
- Override data should feed back into your post-market monitoring process
- There should be no workflow consequences (auto-escalation, manager notification) that deter reviewers from overriding
Provide individual notice
For Annex III high-risk use cases, affected individuals must be told:
- That AI was used in the decision or recommendation about them
- What the AI assessed or scored
- That they have the right to request human review of the AI-assisted decision
- How to exercise that right
This notice must be provided before or at the time the decision is made — not buried in a terms of service update.
Human Oversight for Providers: The Design Checklist
If you are building a high-risk AI system (for example, an HR tech SaaS with AI resume screening), your product must be designed to make oversight possible:
Explainability interface
- Display the factors that drove a recommendation
- Show confidence scores or uncertainty ranges
- Flag outputs that fall outside normal operating ranges
- Differentiate between high-confidence and low-confidence recommendations
Human review workflow
- Hold decisions pending human review — do not automatically execute AI decisions without a review checkpoint
- Clearly label AI-generated outputs as AI-generated
- Provide a structured override mechanism with a reason field
- Confirm override before executing
Auditable records
- Log which outputs were reviewed by a human, by whom, and when
- Log override decisions and reasons
- Provide exportable audit records for compliance review
Documentation for deployers
- Provide instructions for use explaining how human oversight should be implemented
- Document known failure modes and what human reviewers should watch for
- Describe what training reviewers need to exercise meaningful oversight
If your product is designed so that human oversight would slow adoption (auto-approve defaults, friction on override, hidden confidence scores), you have a compliance design problem that cannot be fixed by policy alone.
The Relationship Between Article 14 and GDPR Article 22
Teams operating in the EU face both EU AI Act Article 14 and GDPR Article 22 for AI-assisted decisions.

Both apply in most Annex III scenarios. An AI resume screening tool in the EU triggers both: Article 14 requires oversight to be designed in; Article 22 gives each applicant the right to request human review and explanation.
Satisfying one does not automatically satisfy the other. A system where humans are available for review satisfies Article 14's design requirement — but if applicants are not told they can request that review, Article 22 notice obligations are not met.
