SB 951 (Chapter 860), signed on September 30, 2026, adds AI to California's WARN Act. When a mass layoff, relocation or termination is caused in whole or in substantial part by an AI system or other automated technology that replaces or automates jobs, the employer's 60-day notice must say so and give details. The bill has no operative date of its own, so it takes effect January 1, 2027 under the state constitution's default rule.
Cal/WARN only covers establishments with 75 or more employees in the past 12 months, so most small teams are outside it. If you are covered and automation is a substantial cause of planned cuts, add the technology displacement details to the notice you already owe. SB 947, signed the same day, is the one that reaches small employers: from July 1, 2027 it bars relying solely on an automated decision system to discipline or fire workers, with no size threshold.
Existing Cal/WARN remedies apply, including a civil penalty of up to $500 for each day of the violation.
